1. ABOUT US
VELVET MUSE Pty Ltd (ABN 39 693 689 735), trading as VELVET ("VELVET", "we", "us", "our"), operates shopvelvet.co, an online store selling home textiles on a pre-order basis. This policy applies to shopvelvet.co and to any personal information we collect through it.
2. ABOUT THIS PRIVACY POLICY AND YOUR CONSENT
This policy explains what personal information we collect, how we use and share it, and the choices and rights available to you. By using shopvelvet.co, joining our waitlist, or placing a pre-order, you consent to the collection and use of your personal information as described here. If you don't agree, please don't use the site.
We may update this policy from time to time, see "Changes to this policy" below. This policy isn't directed at children, and we don't knowingly collect personal information from anyone under 13. If you believe a child has given us personal information, contact us at service@shopvelvet.co and we'll delete it.
3. WHAT PERSONAL DATA WE COLLECT AND HOW WE USE IT
We collect:
- Contact details, name, email address, and delivery address, when you sign up to our waitlist (via the site pop-up, password page, or footer form), create an account, or place a pre-order.
- Order information, products ordered, order value, and order history, used to process and fulfil your pre-order and to contact you about it.
- Payment information, handled by our payment partner's secure platform. We never see or store your full card details.
- Marketing preferences, whether you've opted in to receive emails from us, and how you engage with them.
- Device and log data, IP address, browser type and version, pages visited, referring pages, and the time and date of your visit, collected automatically as you browse the site. We may combine this with other data to understand how the site is used and to detect technical errors or misuse.
We use this information to process pre-orders, provide customer service, meet our legal obligations (including under the Australian Consumer Law), send marketing communications you've asked for, and improve the site and our products.
We keep personal information only for as long as we need it for the purpose we collected it, or as required by law, for example, financial records must be kept for at least five years under Australian tax law.
4. WHO WE SHARE YOUR PERSONAL INFORMATION WITH
We do not sell your details to third parties. We disclose personal information to service providers only as necessary to run the store and serve you: hosting and operating the website, processing payments, sending the emails you have opted in to, measuring and advertising the site, and delivering your order. Each provider is bound to use your information only for the service it performs for us.
Some of these providers operate outside Australia, principally in North America. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
We may also disclose personal information to a government authority or regulator where the law requires it, or where reasonably necessary to protect your vital interests.
5. MARKETING AND OPT-OUT
We only send marketing emails to people who've opted in, for example, by joining our waitlist or subscribing at checkout. You can unsubscribe at any time using the link in any marketing email, or by emailing service@shopvelvet.co. Opting out of marketing doesn't affect transactional emails about an order you've placed.
6. HOW YOU CAN ACCESS AND CHANGE YOUR PERSONAL INFORMATION
You can ask us for a copy of the personal information we hold about you, or ask us to correct it, by emailing service@shopvelvet.co. We'll respond within a reasonable time and won't charge you for a reasonable request. If we can't give you access or make a correction, we'll tell you why.
7. SAFEGUARDING YOUR PERSONAL INFORMATION
Our store runs on a platform that uses TLS encryption and industry-standard security controls. Your full payment card details are processed by our payment partner's secure platform and never pass through VELVET's own systems. We take reasonable steps to protect personal information from misuse, loss, and unauthorised access, including by relying on the security measures of our service providers. No method of storage or transmission is completely secure, and we can't guarantee absolute security.
8. YOUR LEGAL RIGHTS
Under the Australian Privacy Principles, you have the right to know what personal information we hold about you, to access and correct it, and to complain if you think we've mishandled it. If you're in the European Union or United Kingdom, you may also have rights under the GDPR or UK GDPR, including the right to erasure and data portability. Contact us at service@shopvelvet.co to exercise any of these rights.
9. WHERE AND HOW TO ASK QUESTIONS OR FILE COMPLAINTS
If you have a question about this policy or how we handle your personal information, or you'd like to make a complaint, email service@shopvelvet.co. We'll try to resolve any complaint within a reasonable time. If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
This policy doesn't cover the privacy practices of any third-party websites we link to. We encourage you to review the privacy policy of any site you visit from shopvelvet.co.
